Agent terms

RENTAL PAY LO is a listing platform operated by Kitros Infotech. An agent account is a business account that, while its subscription is active, may publish up to the fair-use number of live listings without paying a fee for each one. The agent is a user of the Platform, exactly like a single owner - the subscription changes what the agent pays, not what the Platform is.

The Platform is a host for content that agents and owners supply. It is not a broker, agent, intermediary, guarantor or party to any rental. It does not introduce, negotiate, or conclude rentals, and it takes no commission. The relationship the subscription creates is between the agent and Kitros Infotech alone, for the service of publishing.

An agent account becomes usable only after Kitros Infotech has checked the business identity behind it. Until that check is done the account has the status pending, and any listing the agent submits is held for review like an ordinary submission. Once the check is passed the account is active, and listings the agent submits are published automatically.

We may refuse, delay, or withdraw activation for any reason, including where the business details cannot be confirmed. An automatic-publish account is a trust we extend and may withdraw.

Every listing, photograph, price, deposit and word of content an agent posts is the agent’s, and the agent is solely and fully responsible for it. Publishing is automatic because the agent is accountable, not because the Platform has checked anything. We do not inspect, test, approve, verify, edit, or endorse an agent’s listings.

By posting, the agent confirms and warrants that:

• the agent owns, or has the lawful right to rent out, every item listed;
• every listing and photograph is accurate, current, lawful, and not misleading, and depicts the actual item;
• the agent holds every licence, registration or permit that renting the item requires;
• no content infringes any third party’s copyright, trademark, privacy or other rights, and none of it is obscene, defamatory, discriminatory, counterfeit, stolen or prohibited; and
• the agent will deal fairly with renters, honour its own prices and deposits, and not misdescribe an item to obtain a payment.

All risk arising from an agent’s listings, content, pricing, conduct and dealings sits with the agent, not with Kitros Infotech.

By uploading content the agent grants Kitros Infotech a non-exclusive, royalty-free, worldwide licence to store, display, reproduce and resize it on the Platform for the purpose of publishing the agent’s listings, and to keep such copies as are needed for records, moderation and dispute handling. The agent keeps ownership of its own content. We may remove any content at any time under clause 8.

An agent subscription is sold for a fixed term. Current plans are: Agent Monthly at Rs 999 per month, Agent Yearly at Rs 9,999 per year. Prices are exclusive of GST; GST at 18% is added at checkout, so the agent pays base + GST. An introductory first-term price may apply to a new monthly agent, as shown at checkout.

A subscription grants publishing rights for its term and is strictly non-refundable. Once the payment is confirmed the term starts immediately: there is no grace period, no cooling-off period, and no refund or credit for a partial term, an unused term, unused listing capacity, or unused boost credits, whether the agent changes its mind, lists fewer items than it could, gets fewer enquiries than it hoped, or stops using the account early. Boost credits included with a plan expire with that plan and have no cash value.

The only refunds we make are corrections of our own error, and they are limited to: a duplicate charge for the same subscription, or a payment that cleared but for which no subscription was granted. Nothing in this clause limits the general refund policy.

The subscription is active only while its paid term is in the future. When it lapses, the agent’s listings are hidden, not deleted - they stop being public but remain in the account and can be brought back by renewing. Renewing adds days from whichever is later: the existing expiry or the day of payment, so renewing early is not penalised.

“Unlimited” is a fair-use promise, not an absolute one. Each plan carries a cap on simultaneously live listings, and we may adjust caps, rate-limit submissions, and refuse listings that appear to be automated, duplicated or spam. The caps exist so one account cannot flood the directory.

The agent agrees to indemnify and hold harmless Kitros Infotech and its proprietor from and against every claim, demand, loss, liability, cost and expense (including reasonable legal fees) arising out of or connected with: any listing, photograph, price, deposit or content the agent posts; any item the agent rents out or fails to hand over; the agent’s dealings with any renter or other user; the agent’s breach of these terms, of our general terms, or of any law; and any claim by a third party that the agent’s content infringes their rights. This survives the removal of any listing, the lapse or suspension of the subscription, and the end of the agent’s use of the Platform.

We may suspend or terminate an agent account, hide or remove any of its listings, and refuse future use, at our discretion - in particular on a reported or suspected listing, on any breach of these terms, where content appears fraudulent or infringing, or where continuing to publish could expose a renter to loss. Where we can, we will say why. A suspension or termination for breach does not attract a refund, and clauses 3, 4, 5 and 7 continue to apply. Where a report against the agent is upheld we may apply a strike; repeated upheld reports may end the account.

The Platform is provided “as is”. Kitros Infotech gives no guarantee of enquiries, views, rentals, ranking, uptime or results, and no guarantee that any listing will be seen or that any rental will occur. A subscription buys publishing capacity and nothing more.

To the maximum extent permitted by law, Kitros Infotech is not liable for any loss arising from the agent’s use of the Platform or from any content on it, including loss of business, profit, rent, or data, and including indirect and consequential loss. Nothing here excludes liability that cannot lawfully be excluded, such as liability for fraud or fraudulent misrepresentation.

Our terms place every risk we can lawfully place on you. A small number of things are, by their nature, simply not ours to bear - and we say so plainly rather than pretend otherwise:

• The rental-agreement generator. This is a self-service tool that fills a template with the details you type. We do not provide legal advice, we do not draft or review your agreement, and we do not warrant that a generated document is valid, enforceable, correctly stamped, notarised or registered. Whether an agreement is legally sound, correctly executed, adequately witnessed, or suitable for your tenancy is entirely your responsibility; take independent legal advice if it matters. This is the one area the document itself is not “ours” - the tool is ours, the agreement it prints is yours.
• Third-party services. Payments are handled by our payment gateway and hosting by our infrastructure providers under their own terms. We are not responsible for their acts, omissions, outages or errors.
• Anything the law will not let us exclude. Where a liability cannot lawfully be excluded, it is not excluded - but nothing else in this clause is a promise, and everything else in these terms stands.

We may update these terms. The date at the top of this page shows when they last changed. Continuing to use an agent account after a change means the agent accepts the revised terms.

These terms are governed by the laws of India. Subject to clause 9, the courts at Andhra Pradesh have exclusive jurisdiction over any dispute arising from them. Questions and complaints can be raised through our contact page or under our grievance policy.
