RENTAL AGREEMENT

1. Parties

THIS AGREEMENT is made and executed at ________________ on ________, BETWEEN:

2. The residential premises

3. Term

5. Security Deposit

The deposit is refundable within a reasonable period after the Lessee returns the residential premises, after deducting arrears of rent, unpaid charges, the cost of repairing damage beyond normal wear and tear, and any other amount due under this agreement.

6. Use

The premises shall be used only for residential purposes by the Lessee and the Lessee's immediate family, and for no other purpose without the Lessor's prior written consent.

The Lessee shall not carry on any trade, business or commercial activity in the premises, and shall not use it for any unlawful, immoral or offensive purpose.

The Lessee shall comply with the rules of any co-operative society, apartment association or local authority having jurisdiction over the premises.

7. Repairs, Maintenance and Outgoings

Day-to-day maintenance and minor repairs shall be borne by the Lessee (Tenant); structural repairs, unless caused by the Lessee's negligence or misuse, shall be the Lessor's responsibility.

The Lessee shall pay electricity, water, gas, and society/association maintenance charges for the premises as and when due.

The Lessee shall not make structural alterations or additions without the Lessor's prior written consent.

8. Entry and Inspection

The Lessor or the Lessor's representative may, on reasonable prior notice and except in an emergency, enter and inspect the premises at reasonable hours.

9. Notices

Any notice shall be in writing and is sufficiently served if delivered personally, sent by registered post or courier, or sent by email/WhatsApp to the contact of the receiving Party last known to the sender.

10. Default and Termination

Either Party may terminate this arrangement by giving 30 days' written notice to the other, without prejudice to any accrued right or remedy.

The Lessor may terminate and take back the residential premises forthwith, in accordance with law, if the Lessee fails to pay rent when due, breaches any material term and does not cure it within a reasonable time of written notice, uses the residential premises for an unlawful purpose, or causes wilful damage.

On termination the Lessee shall peacefully return the residential premises to the Lessor.

11. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872; the Transfer of Property Act, 1882; the applicable tenancy / Rent Control law in force in the applicable State; the Registration Act, 1908.

The courts at ________ shall have exclusive jurisdiction over any dispute arising out of or in connection with this agreement, to the exclusion of all other courts.

12. Stamp Duty, Execution and Registration

Stamp duty shall be paid as prescribed under the applicable State Stamp Act for the applicable State, for the term and rent recorded above.

A lease for a term of twelve (12) months or more, or as otherwise required by the Registration Act, 1908 and the applicable State law, may require registration; the Parties shall complete such stamping, notarisation or registration as the law requires.

This agreement shall be executed on stamp paper of the value prescribed by the applicable State Stamp Act. The stamp paper shall be affixed and cancelled, and this agreement notarised where required, before or at the time of execution.

Each Party shall bear their own cost of stamping, notarisation and registration unless otherwise agreed in writing.

13. Witnesses and Execution

The Parties have read and understood this agreement and sign it voluntarily, in the presence of the witnesses named below, on the date first written above. This agreement records the entire understanding between the Parties on this subject.
